Evictions following the purchase of real property at a foreclosure sale are governed by state and federal law. In Nevada, the following process is applicable:
IF THE CURRENT OCCUPANT IS THE PREVIOUS OWNER
The first step to removing the previous owner is a Three Day Foreclosure Notice. This is followed by a Five Day Unlawful Detainer Notice and then the filing a Complaint for Unlawful Detainer.
IF THE CURRENT OCCUPANT IS A TENANT WITHOUT A LEASE
The first step to removing a tenant without a lease or with an expired lease is a Ninety Day Foreclosure Notice. This is followed by a Five Day Unlawful Detainer Notice and then the filing a Complaint for Unlawful Detainer.
IF THE CURRENT OCCUPANT IS A TENANT WITH A LEASE
If the current occupant is a tenant with an unexpired lease, the new owner assumes the lease. Certain exceptions to this rule apply. The tenant is obligated to pay rent to the new owner.
